Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the website [website URL] and the guided fishing charter services provided by Pete's Fishing & Guided Adventures ("Company," "we," "us," or "our"). By booking a trip, submitting a deposit, or using our website, you agree to be bound by these Terms.

2. Eligibility and Participation

 

You must be at least 18 years of age to book a guided fishing charter. Minors may participate only when accompanied by a parent or legal guardian who accepts full responsibility for the minor’s conduct and safety.

All participants must be physically capable of participating in a guided fishing activity and must disclose any relevant medical conditions that could impact safety.

 

3. Bookings and Deposits

 

  • ​All bookings are subject to availability and confirmation by the Company.

  • A deposit may be required at the time of booking to secure your reservation.

  • Remaining balances, if any, are due prior to or on the date of the scheduled trip, as communicated at booking.

  • Deposits are applied toward the total trip cost.

4. Cancellations, Rescheduling, and No-Shows

 

Deposits and Payments

  • A deposit only is required at the time of booking to secure your reservation.

  • Deposits are non-refundable, except in the limited circumstances expressly described below for Company-initiated weather cancellations.

  • Deposits constitute liquidated damages and are agreed by the parties to represent a reasonable estimate of administrative costs, lost booking opportunities, staffing, and scheduling impacts, and are not a penalty under Oregon law.

  • The remaining balance is due on the date of the scheduled trip, prior to departure, unless otherwise stated at booking.

Customer-Initiated Cancellations

  • Cancellations made 7 days or more prior to the scheduled trip are eligible for a one-time reschedule at the Company’s discretion, subject to availability. Deposits will be applied to the rescheduled trip but will not be refunded.

  • Cancellations made within 7 days of the scheduled trip will result in forfeiture of the deposit.

  • No-shows, late arrivals, or failure to be ready at the scheduled departure time will result in forfeiture of the deposit and may be charged the full trip amount at the Company’s discretion.

Company-Initiated Cancellations (Weather and Safety)

  • The Company retains sole and absolute discretion to determine whether weather, sea state, river conditions, mechanical issues, regulatory restrictions, or other safety-related factors make a trip unsafe or impractical to operate.

  • If the Company cancels a trip solely due to weather or safety conditions, customers may elect one of the following remedies:

    • A full refund of the deposit, or

    • A rescheduled trip with the deposit applied in full.

  • No additional compensation, damages, or reimbursement of incidental expenses (including travel or lodging) will be provided.

Early Termination

  • Trips terminated early due to changing weather conditions, safety concerns, mechanical issues, or participant conduct are not eligible for refunds or credits, as the service is deemed to have commenced.

By booking a trip, you expressly acknowledge and agree to this cancellation and refund policy.

 

5. Guide Authority and Safety

 

The guide retains full authority over all trip decisions, including departure times, fishing locations, duration, and early termination of a trip due to safety, weather, or conduct concerns.

All participants must follow the guide’s instructions at all times. Failure to do so may result in removal from the trip without refund.

 

6. Assumption of Risk

 

Fishing and boating activities involve inherent risks, including but not limited to weather conditions, water hazards, equipment use, and physical exertion. By participating, you voluntarily assume all risks associated with the activity.

 

7. Limitation of Liability

 

To the fullest extent permitted by Oregon law, Pete's Fishing & Guided Adventures, its owner, agents, and employees shall not be liable for any injury, loss, damage, or expense arising from participation in guided fishing activities, except where caused by gross negligence or willful misconduct.

 

8. Alcohol, Drugs, and Conduct

  • Illegal drugs are strictly prohibited.

  • Alcohol consumption may be restricted at the guide’s discretion.

  • Disorderly, unsafe, or abusive behavior will result in immediate termination of the trip without refund.

 

9. Licenses and Compliance

 

Participants are responsible for obtaining all required Oregon fishing licenses and tags prior to the trip, unless otherwise stated. All fishing activities are subject to Oregon Department of Fish and Wildlife (ODFW) regulations.

 

10. Media Release

 

Unless otherwise requested in writing prior to the trip, participants grant the Company permission to use photographs or videos taken during trips for marketing, social media, and promotional purposes without compensation.

 

11. Website Use

 

You agree not to misuse the website, interfere with its operation, or attempt unauthorized access to any systems or data.

 

12. Privacy

 

Your use of the website and services is also governed by our Privacy Policy, which includes GDPR and Oregon Consumer Privacy Act (OCPA) disclosures.

 

13. Governing Law and Venue

 

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict of law principles. Any legal action shall be brought exclusively in the state or federal courts located in Oregon.

 

14. Modifications to Terms

 

We reserve the right to modify these Terms at any time. Updated Terms will be posted on the website with a revised effective date. Continued use of the website or services constitutes acceptance of the updated Terms.
